1. Agreement to Terms

By accessing or using red-sted.com (the “Service”), operated by Red Sted (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the Service.

Language: By proceeding, you expressly acknowledge that you have chosen to read and accept these Terms in English. En poursuivant, vous reconnaissez expressément avoir choisi de lire et d'accepter les présentes conditions en anglais.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

2. Description of Service

Red Sted is a software-as-a-service platform that provides automated Bitcoin (BTC) trading tools, trade analysis, and edge-scoring algorithms. The Service connects to third-party cryptocurrency exchanges (currently Kraken Futures) via user-provided API keys.

Red Sted is a software tool. We do not act as a broker, dealer, exchange, custodian, investment adviser, or commodity trading advisor. We do not have access to, hold, manage, or control your funds at any time.

4. Risk Acknowledgment

By using the Service, you expressly acknowledge and agree that:

• Cryptocurrency trading involves substantial risk of loss. You may lose some or all of your invested capital. Leveraged futures trading carries especially high risk.
• Past performance is not indicative of future results. Simulated, backtested, or historical results do not guarantee future trading outcomes and may over- or under-compensate for the impact of market factors such as liquidity and slippage.
• Automated trading systems can malfunction, experience connectivity issues, or execute trades based on outdated data.
• Exchange API rate limits, downtime, or changes may cause the bot to miss entries, exits, or stop-loss orders.
• Red Sted has no control over and makes no guarantees regarding the availability, reliability, or security of third-party exchanges.

5. User Responsibilities

• You are solely responsible for configuring, starting, pausing, and stopping your trading bot(s).
• You must use API keys with trade-only permissions. Never use API keys that have withdrawal access. We recommend using Kraken Futures Demo for paper trading before risking real capital.
• You must comply with all applicable laws and regulations in your jurisdiction, including any requirements related to cryptocurrency trading, tax reporting, and financial regulations.
• You are responsible for the security of your account credentials and API keys.

Acceptable Use

You agree not to use the Service to:

• Engage in market manipulation, wash trading, spoofing, or any activity that violates exchange rules or applicable law
• Intentionally spam, overload, or abuse the Kraken API (or any connected exchange API) through the Service in a manner that could result in rate-limiting, IP bans, or service degradation for other users
• Reverse engineer, decompile, or attempt to extract the source code of the Service's algorithms
• Share your account credentials or allow others to access the Service through your account

6. API Key Security

Your exchange API keys are encrypted with AES-256-GCM before storage. The encryption key resides in our server environment variables, not in the database. We never log, display, or transmit your raw API keys after initial encryption.

Despite these measures, no system is 100% secure. We are not liable for any unauthorized access to your API keys or exchange accounts resulting from data breaches, vulnerabilities, or circumstances beyond our reasonable control.

7. Subscriptions and Billing

Paid plans are billed monthly through Stripe. All plans include a 7-day free trial.

Important: Free Trial Disclosure

When you start a free trial, you provide payment information upfront. Your subscription will automatically convert to a paid monthly plan at the end of the 7-day trial period unless you cancel before the trial ends. The price of the plan you selected will be clearly displayed at checkout before you begin your trial. You may cancel at any time from your account settings — cancellations take effect at the end of your current billing period. We do not offer refunds for partial billing periods.

By starting a free trial, you expressly acknowledge and consent to the automatic billing described above.

Subscription fees cover access to the software platform only. They are not fees for trading, investment management, or financial advisory services. Trading losses are not refundable under any circumstances.

8. Intellectual Property

All content, algorithms, designs, code, and materials on the Service are owned by Red Sted and protected by copyright and intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the Service without prior written consent.

9. Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED STED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service;
• Any trading losses, missed opportunities, or financial losses arising from your use of the Service;
• Unauthorized access to or alteration of your data or API keys;
• Any interruption, suspension, or termination of the Service;
• Any bugs, errors, or inaccuracies in the Service's algorithms, edge scores, or outputs.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO RED STED IN THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE THOUSAND CANADIAN DOLLARS (CAD $1,000).

10. Indemnification

You agree to indemnify and hold harmless Red Sted from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your trading activities.

11. Account Termination

We may suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms. You may delete your account at any time from Security Settings. Upon termination, your right to use the Service ceases immediately and your encrypted API keys are permanently deleted.

12. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via the email associated with your account. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the federal laws of Canada and the laws of the province in which Red Sted operates. In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If unresolved after 30 days, either party may pursue the matter in the courts of competent jurisdiction in Canada.

Consumer Protection: Nothing in these Terms limits or waives any rights you may have under applicable consumer protection legislation, including your right to bring proceedings in a court of competent jurisdiction or to participate in a class action, where such rights cannot be waived by agreement.
